Terms of service

Welcome to ToysWoys. These Terms of Service ("Terms") govern your use of www.toyswoys.com and any related services (together, the "Platform"), operated by ToysWoys, a sole proprietorship with its principal place of business at 28 Vaishali Nagar, Jaipur, Rajasthan 302021, India (GSTIN 08DKNPK1551E1CH) ("ToysWoys", "we", "us", "our").

By accessing the Platform, creating an account or placing an order, you agree to these Terms, our Privacy Policy, Refund & Return Policy, Shipping Policy, Cancellation Policy and Product Safety & Compliance note, which form part of these Terms. If you do not agree, please do not use the Platform.

1. About ToysWoys: a marketplace

ToysWoys is an online marketplace. We provide a technology platform where independent third-party brands and sellers ("Sellers") list and sell toys, hobby products, clothing, stationery and other products for children to buyers in India.

  • Sellers are the sellers of record. Unless a product page clearly says it is sold by ToysWoys, your purchase contract is directly between you and the Seller.
  • ToysWoys acts as an intermediary under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and as a marketplace e-commerce entity under the Consumer Protection (E-Commerce) Rules, 2020.
  • ToysWoys does not manufacture the products listed by Sellers and does not own their inventory. We earn a commission from Sellers for sales made through the Platform.
  • Seller details (such as name, address and contact information) are shown on the product page or invoice, as required by law.

2. Eligibility

  • You must be 18 years or older and able to enter into a legally binding contract under the Indian Contract Act, 1872 to create an account or place an order.
  • If you are under 18, you may browse the Platform only under the supervision of a parent or legal guardian, who must create the account and place any order. The parent or guardian is responsible for all activity on the account.
  • We may refuse service, suspend or close accounts at our discretion if we believe these Terms have been broken.

3. Your account

  • Provide accurate, current and complete information and keep it updated.
  • Keep your password confidential. You are responsible for all activity on your account.
  • Tell us immediately at toyswoysworld@gmail.com if you suspect unauthorised use.

4. Products and listings

  • Product information (descriptions, images, specifications, age grading, size charts, country of origin, certifications, MRP and manufacturer details) is provided by Sellers. Sellers are responsible for ensuring it is accurate, complete and lawful.
  • We try to ensure listings are accurate but do not guarantee that every description, colour or image is error-free. Colours may look slightly different on different screens.
  • Age grading and safety warnings on product pages and packaging are there to protect children. Please read and follow them. Adult supervision is recommended for young children.
  • Sellers are solely responsible for the quality, safety, legality and compliance of their products, including BIS/ISI certification for toys where required. See our Product Safety & Compliance note.

5. Pricing, MRP and taxes

  • All prices are in Indian Rupees (₹) and include applicable taxes (GST) unless stated otherwise. Shipping charges, if any, are shown separately at checkout.
  • Prices are set by Sellers. No product will be sold above its Maximum Retail Price (MRP) as printed on the product or declared under the Legal Metrology (Packaged Commodities) Rules, 2011.
  • Prices and availability can change without notice. The price that applies is the one shown at the time you place your order.
  • If a product is listed at an obviously incorrect price because of a technical or typographical error, we or the Seller may cancel the order and give you a full refund.
  • Discounts, coupons and offers are subject to their own terms and may be withdrawn at any time. Unless stated otherwise, offers cannot be combined or exchanged for cash.

6. Orders and payment

  • Placing an order is an offer to buy. An order is accepted when the Seller confirms it or dispatches it. We will send you confirmation by email, SMS or WhatsApp.
  • We or the Seller may cancel an order for reasons including stock unavailability, pricing errors, suspected fraud, or delivery not being possible to your PIN code. If you have already paid, you will receive a full refund.
  • Payments are processed through secure third-party payment gateways. Payment methods available (such as UPI, cards, net banking, wallets or cash on delivery) are shown at checkout and may vary by order or location.
  • Tax invoices are issued by the Seller (or by ToysWoys where it is the seller of record).

7. Shipping, cancellation, returns and refunds

Shipping, cancellation, returns and refunds are covered in our Shipping Policy, Cancellation Policy and Refund & Return Policy. We currently ship within India only.

8. Reviews and user content

  • You may post reviews, ratings, photos and questions ("User Content"). User Content must be honest, based on your own experience, and must not be false, misleading, abusive, obscene, defamatory, infringing, or harmful to children.
  • Do not post personal information about children (such as faces, names, schools or locations) in reviews.
  • You give ToysWoys a non-exclusive, royalty-free, worldwide licence to use, display and reproduce your User Content on the Platform and in related marketing.
  • We may remove User Content that breaks these Terms or the law.

9. Prohibited use

You agree not to:

  • use the Platform for any unlawful purpose or to buy products for resale in commercial quantities without our consent;
  • provide false information, impersonate anyone or use another person's account;
  • interfere with the Platform's security or operation, or use bots, scrapers or similar tools without permission;
  • upload viruses or harmful code;
  • misuse offers, coupons, returns or refunds, or place fraudulent orders;
  • post content that is harmful to children or otherwise prohibited under the IT Rules, 2021.

10. Intellectual property

The ToysWoys name, logo, website design and content created by us belong to ToysWoys or its licensors. Brand names, logos and product images belong to their respective owners. You may not copy, reproduce or use any of this content without written permission.

If you believe content on the Platform infringes your intellectual property, please contact our Grievance Officer with details.

11. Disclaimers

  • The Platform is provided on an "as is" and "as available" basis. We do not guarantee that it will always be uninterrupted or error-free.
  • Since ToysWoys is a marketplace, product warranties, guarantees and quality claims are given by the Seller or manufacturer, not by ToysWoys, unless we sell the product ourselves. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.

12. Limitation of liability

To the maximum extent allowed by law:

  • ToysWoys is not liable for any indirect, incidental, special or consequential loss, or loss of profits, data or goodwill, arising from your use of the Platform.
  • ToysWoys is not liable for defects, safety issues, mislabelling or non-compliance in products sold by Sellers. Such claims lie against the Seller and/or manufacturer. We will, however, help you contact the Seller and resolve your complaint through our grievance process.
  • Our total liability to you for any claim relating to an order will not be more than the amount you paid for that order.

Nothing in these Terms excludes liability that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.

13. Indemnity

You agree to indemnify ToysWoys against any claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party rights.

14. Suspension and termination

We may suspend or close your account, or restrict access to the Platform, if you break these Terms, misuse the Platform, or if required by law. You may close your account at any time by contacting us.

15. Force majeure

We and our Sellers are not responsible for delays or failure to perform caused by events beyond reasonable control, such as natural disasters, epidemics, strikes, government action, network failures or courier disruptions.

16. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to your rights to approach a consumer commission under the Consumer Protection Act, 2019, the courts at Jaipur, Rajasthan shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Platform.

18. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continuing to use the Platform after changes means you accept the updated Terms.

19. General

If any part of these Terms is found invalid, the rest will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the policies referred to above, are the entire agreement between you and ToysWoys about your use of the Platform.
